The Senate needs a simple majority to confirm or reject a nominee, according to Article II, Section 2, clause 2 of the Constitution. The Senate has refused to confirm only about nine Cabinet nominees, although many more nominees have been withdrawn because they were likely to be rejected by the Senate.
