Facts: During 1971, The New York Times got a hold of leaked documents from the Pentagon all about the current war in Vietnam. The Government fearing that it might put troops at risk decided to use prior restraint to stop the production of the newspaper but the New York Times challenged their use of prior restraint saying that it was unconstitutional. Issue: Is it constitutional for the government to use prior restraint to stop production of a newspaper? Ruling: The Supreme court decided that it was unconstitutional to stop the New York Times from printing the paper and also decided that printing such material wouldn't risk the lives of troops.
